Time Standards
These guidelines relate to time standards for the processing of cases in the
Probate Court. The time standards are effective as of October 25, 2006.
- Inventories - Due 30 days after letters are granted. The settlement
clerk may grant one continuance to a date certain not to exceed 30 days.
- Settlements and Personal Status Reports - A notice is sent 30 days
prior to the due date. The settlement/report should be filed on the due date.
The settlement clerk may grant one continuance to a date certain not to exceed
30 days.
- Correcting Settlements - After audit the settlement must be
corrected within 30 days (60 days for a final settlement). The auditor may grant one continuance to a date
certain not to exceed 30 days.
- Bonds - 30 days are granted to comply with an order to post an original and/or
additional bond. The bond clerk may grant one continuance to a date certain not to
exceed 30 additional days.
If additional continuances are required with respect to the foregoing, all
such requests must be submitted to the Judge or a Commissioner.
DOCKETS GENERALLY
- Every effort should be made to hear matters on the first setting.
Matters should be docketed in order to facilitate disposition on the first setting.
Continuing a matter generally will no longer be permitted. All continuances must
be to a date certain.
- When no one appears the matter may be dismissed without prejudice.
- When a matter is passed for settlement, the settlement documents must be
filed within 30 days. Upon failure to file the settlement documents, the
matter may be dismissed without prejudice. However, if settlement documents
are subsequently filed, the dismissal will be set aside and the settlement entered
in lieu of the previous dismissal.
